Terms and Conditions
1. Payment
1.1 Payment must be made in full by card and reflect in our account at least 10 days before the training to secure the booking.
1.2 The acceptance of any proof of payment submitted by an attendee is at the sole discretion of management and is not guaranteed.
1.3 If student is granted access to a class based on submitted proof of payment, the attendee and/or their sponsoring company shall be held jointly and severally liable for the full cost of the course(s) and any associated examinations.
1.4 Failure to attend any part of the course or examinations will not reduce or cancel the enrolment fee. Full payment remains due, regardless of attendance.
2. Cancellation, Rescheduling and Refunds
2.1 Data4Every1 reserve the right to modify, cancel, or reschedule any course or instructor at our discretion. If such changes occur, we will make reasonable efforts to inform you at least one week in advance. There will be no charge for cancellations or changes initiated by Data4Every1 or Data4Every1.
2.2 For public scheduled training at any Data4Every1, the cancellation period is 9 working days. If the student or company cancels or reschedules the course at least 10 days before the start date, no cancellation fee will apply. A 100% cancellation fee will be charged if the cancellation occurs within 9 days of the course start date.
2.3 For Veeam courses at Data4Every1 branch, the cancellation period is 16 working days. If the student or company cancels or reschedules at least 17 days prior to the course start date, no cancellation fee will apply. A 100% cancellation fee will apply for cancellations within 16 days of the start date.
2.4 If a student re-enrolls in a course that was not cancelled within the specified cancellation period, a fee equal to 50% of the course cost will apply. This applies within a 6-month window from the original course date.
2.5 For onsite training at the client’s location, the cancellation period is 11 working days. If the student or company cancels or reschedules at least 12 days before the course start date, no cancellation fee will apply. A 100% cancellation fee will be charged for cancellations made within 11 days of the course start date.
2.6 If a delegate is sponsored by an OEM (e.g., Huawei) for training at Data4Every1 using learning vouchers or credits, the sponsoring partner or end customer agrees to follow the cancellation and rescheduling terms of Data4Every1. Failure to notify us of a cancellation or non-attendance will result in the sponsor or customer being fully liable for the full retail cost of the course.
3. Re-Attendance
3.2 A charge for re-attending courses will apply for the following vendors, and the exact fee will be advised upon request:
- Check Point, Huawei, ITIL & DevOps, JAVA, Linux, Microsoft End User, Python, Soft Skills
3.3 30% of the course cost will apply for the following vendors:
- AWS, CertNexus, Veeam, VMWare
3.4 15% of the course cost will apply for the following vendors:
- CompTIA, Cisco, Microsoft Technical
3.5 This benefit excludes any exam-related fees.
4. Enrolment
4.1 All courses must be completed within eight (8) months from the date of purchase. Failure to do so will result in the forfeiture of any associated fees.
4.2 The student acknowledges that they have reviewed and understood the prerequisites for the course(s) listed on the enrolment form. It is the student’s responsibility to ensure that these requirements are met before attending the course. Data4Every1 and Data4Every1 will not be held responsible if the student is unable to complete the course due to unmet prerequisites and reserves the right to ask the student to leave the course.
4.3 The student acknowledges that successful completion of the course requires a minimum of 80% attendance. If this attendance requirement is not met, the student will be recorded as having ‘insufficient course attendance.’ Insufficient attendance will disqualify the student from receiving a Data4Every1 electronic attendance certificate.
4.4 For one-day courses, the student acknowledges that 100% attendance is required for successful completion. Failure to achieve this attendance will result in the student being recorded as having ‘insufficient course attendance,’ and they will not be eligible for the Data4Every1 electronic attendance certificate.
4.5 The validity of classroom-based exam vouchers is eight (8) months from the date of purchase.
4.6 The validity of Pearson VUE exam vouchers is six (6) months from the date of purchase.
4.7 Exam vouchers must be requested from Data4Every1 within 6 months of completing the relevant course that included an exam.
5.Independent Courses
Please note that Cisco training courses presented by Data4Every1 are vendor independent. The training, including course materials, labs, and instruction, does not form part of the official vendor’s learning channel.
6. Recovery
6.1 In the event that any action is required to recover outstanding payments or enforce any part of these terms and conditions, the student/company acknowledges that they will be liable for all legal costs, including attorney fees, tracing agent costs and collection commission, as per the scale between attorney and client.
7. Domicilium
7.1 The student/company hereby nominates the address listed on the enrolment form as their domicilium citandi et executandi for the purpose of receiving notices and legal documents related to this agreement.
8. Jurisdiction
8.1 The student/company consents, as per Section 45 of the Magistrates Court Act 32 of 1944, to the jurisdiction of the Magistrates Court in any legal action initiated by Data4Every1, even if the claim exceeds the court’s usual jurisdiction.
9. Waiver
9.1 Any relaxations or concessions made by Data4Every1 to the student/company should not be interpreted as a waiver of any of our rights under this agreement. Such actions should not be seen as reducing the student’s or company’s liabilities.
10. Sole Agreement
10.1 This agreement and the associated terms and conditions represent the entire understanding between Data4Every1 and the student/company. Any amendments to this agreement will only be valid if they are made in writing and signed by all relevant parties or their duly authorised representatives.
10.2 Personal items brought onto the training premises by the student or company are the sole responsibility of the owner. Data4Every1 and Data4Every1 accepts no responsibility for such items.
10.3 Data4Every1 is not liable for any changes or updates made to vendor course/exam versions during the course/exam period. While we strive to inform customers of such changes in advance, these updates may not always align with the student’s course/exam schedule. Students will be liable for any cost differences related to attending a course/exam with a new vendor version. Students wishing to reschedule their course/exam dates to accommodate version upgrades must do so within the cancellation period.
10.4 Data4Every1 will not exchange any pre-issued courseware. If there are changes to the vendor courseware version before the course begins, the student will be responsible for the full cost of the updated courseware.
11. Liability
11.1 Data4Every1 will not be held liable for any loss, damage, costs, or expenses resulting from inaccurate information, misrepresentations, negligence, fraudulent actions, or defaults by the client, its directors, employees, contractors, or agents. The client agrees to indemnify and hold Data4Every1 harmless from any claims arising from such incidents and to cover the costs incurred by the company in defending such claims.
12. Warranties
12.1 Data4Every1 does not make any representations or warranties regarding the lecturers. However, we strive to maintain a high standard of training. If the student is dissatisfied with the standard of training, it is their responsibility to provide evidence to support this.
13. Damages
13.1 The student acknowledges that they will be handling valuable computer equipment and agrees to be held responsible for any damage caused to the equipment due to negligence or improper handling.
14. Examination Identification Requirements
14.1 When registering for an exam at a Data4Every1, the student must present an original and valid identification document (ID) that is officially recognised in their country of citizenship or permanent residence. If a formal ID is unavailable, a driver’s license may be accepted. Foreign nationals must provide an official passport.
14.2 Students are required to bring their original and valid identification documents (ID, driver’s license, or passport) each time they report to the test centre. It is the student’s responsibility to ensure that their ID is up to date and available on the exam day. Before entering the testing room, students will be verified and admitted by the Test Administrator, following the exam centre’s entry requirements.
14.3 Failure to present the required identification will result in the student being unable to take the exam, and they will forfeit the fee paid for the exam. In such cases, the student must re-register for the exam.
14.4 The ID documents must meet the following criteria:
14.4.1 Be an original document; photocopies will not be accepted.
14.4.2 Be a government-issued national, state, or provincial identity card recognised by the country of citizenship or permanent residency.
14.4.3 Be valid and not expired; expired documents will not be accepted.
14.4.4 Display the student’s full name exactly as it was when registering for the test (excluding accents), along with a recent, clear photograph.
14.4.5 Include the student’s signature; the name and signature on the ID must match the registration details.
15. VMWARE Education Reseller Partner (VERP) Course Cancellation Policy
15.1 VERPs resell course placements for courses delivered directly by VMware’s Education team.
15.2 Course fees are non-refundable if the student cancels or changes the class less than 11 business days before the scheduled class start date.
15.3 You can avoid the cancellation fee by designating another person to attend the class in your place.
15.4 If you are unable to attend the class and fail to notify Data4Every1 at least 11 business days before the class, you will forfeit the entire course fee. This is due to Data4Every1 being bound by VMware’s reseller terms and conditions.
15.5 Any cancellations or changes to the course must be submitted in writing and received by Data4Every1 at least 11 business days prior to the course start date.
15.6 VMware, Inc. reserves the right to cancel or reschedule any class. In the event of such changes, VMware will make reasonable efforts to notify the VERP Reseller (Data4Every1) and the candidates at least 11 business days in advance. However, in certain circumstances, VMware may have to notify with less time. If VMware cancels or reschedules, they will refund only the course fees to Data4Every1, who will then credit the student’s account.
16. Course Delivery Policy
All online training sessions are delivered via Microsoft Teams. Access details are provided electronically and no physical materials are shipped. Once payment has been received an attendee registration form will be emailed to collect the required student information. After the completed form has been returned and the booking has been confirmed all registered attendees will receive their Microsoft Teams joining link by email a few days before the scheduled course date. Attendees are responsible for ensuring that the email address provided during registration is accurate and monitored. If the joining link has not been received 48 hours before the scheduled session, attendees must notify us so that we can resend the information and ensure access to the course. Each course includes hands-on practical labs, where participants complete exercises to demonstrate their understanding of the material. Upon successful completion of the course, each attendee will receive a digital certificate of attendance
17. Training Prerequisites
It is the responsibility of the student to ensure that they meet the stated prerequisites for the selected training course prior to attendance. Students who do not meet the required prerequisites may find the course unsuitable and no liability will be accepted for any resulting lack of progress or comprehension.
